§ 1 Buchungsbestätigung
Das Mietverhältnis für das Ferienhaus-Wehr ist rechtskräftig mit Erhalt der
Buchungsbestätigung, sowie nach erfolgter Anzahlung (siehe §2). Mit Überweisung
der Anzahlung erkennen der Mieter und seine Mitreisenden die AGB und die
Hausordnung als verbindlich an.
§ 2 Zahlung
Die in der Buchungsbestätigung ausgewiesene Anzahlung in Höhe von 20%,
mindestens jedoch 200€ ist innerhalb von 7 Tagen nach der Buchungsbestätigung
auf das Konto des Vermieters zu überweisen.

Verwendungszweck: Zeitraum der Vermietung mit Namen
Leistet der Mieter die Anzahlung nicht termingerecht, so ist der Vermieter berechtigt,
das Ferienhaus an andere zu vermieten.
Die Restzahlung ist 30 Tage vor Anreise fällig. Bei kurzfristigen Buchungen ist
der Reisepreis unverzüglich zu überweisen.
§ 3 An- und Abreise
Am Anreisetag steht das Ferienhaus ab 14:00 Uhr zur Verfügung.
Schadensersatzansprüche können nicht geltend gemacht werden, wenn das
Ferienhaus ausnahmsweise nicht pünktlich um 14:00 Uhr bezogen werden kann. Am
Abreisetag ist die Ferienwohnung ab 10.00 Uhr besenrein zur Verfügung zu stellen.
§ 4 Mietobjekt
Das Ferienhaus wird mit vollständigem Inventar vermietet. Etwaige
Fehlbestände, Mängel oder Beschädigungen sind dem Vermieter unverzüglich zu
melden. Über den Zustand der Wohnung und des Inventars werden eventuelle
Missstände nur innerhalb 24 Stunden ab Ankunft anerkannt. Danach müssen evtl.
beschädigte/ fehlende Gegenstände ersetzt werden.
Das Inventar ist schonend und pfleglich zu behandeln, Haustiere sind weder auf dem Sofa noch in den Betten erwünscht. Das
Inventar ist nur für den Verbleib in dem
Ferienhaus vorgesehen. Der Mieter haftet für Schäden, die durch schuldhafte
Verletzung der ihm obliegenden Sorgfalts- und Anzeigepflicht entstehen, besonders
bei unsachgemäßer Behandlung technischer Anlagen und anderer
Einrichtungsgegenstände. Der Mieter haftet auch für das Verschulden seiner
Mitreisenden. Entstandene Schäden durch höhere Gewalt sind hiervon
ausgeschlossen.
Bei vertragswidrigem Gebrauch des Ferienhauses, wie Untervermietung,
Überbelegung, Störung des Hausfriedens etc., sowie bei Nichtzahlung des vollen
Mietpreises (§ 2) kann der Vertrag fristlos gekündigt werden. Der bereits gezahlte
Mietzins bleibt bei dem Vermieter.
Bettbezüge, Betttücher und Handtücher sind Teil des Mietumfanges, eine Mitnahme zu den Stränden ist untersagt und wird in
Rechnung gestellt.
Der WLAN-Anschluss ist Bestandteil der Mietsache, ein Dauerhaftes streamen von Videos sollte dennoch vermieden werden.
Kosten für Strom-, Wasser- und Heizungsverbrauch sind in der Miete enthalten,
solange diese im üblichen Rahmen liegen. Sollte der Stromverbrauch über 20
kWh/Tag und der Wasserverbrauch über 0,5 m³ /Tag liegen, hat der Mieter die über
diesen Verbrauch hinausgehenden Kosten zu tragen.
Die Hausordnung ist Bestandteil der Buchungsbestätigung.
Verstöße gegen die Hausordnung und/ oder die AGBs können zur sofortigen
Beendigung des Mietvertrages.
Ersatzansprüche für bereits geleistete Miete bestehen in einem solchen Falle nicht.
§ 5 Aufenthalt
Der Mindestaufenthalt für das Ferienhaus beträgt mindestens 2 Übernachtungen.
Das Ferienhaus darf höchstens mit der in der Buchungsbestätigung angegebener Personenzahl belegt werden. Bei Überbelegung
hat der Vermieter das Recht, überzählige Personen abzuweisen oder den entsprechenden Aufpreis einzuziehen.
§ 6 Reiserücktritt/Stornierungsbedingungen
Ein notwendiger Rücktritt von der Reise muss schriftlich mitgeteilt werden.
Im Falle des Rücktritts bleibt der Anspruch des Vermieters auf Bezahlung des
vereinbarten Reisepreises bestehen. Der Vermieter hat einen Ersatzanspruch nach
folgender Staffelung:
Bis zum 90. Tag vor Reiseantritt 20 % des Reisepreises.
Bis zum 60. Tag vor Reiseantritt 60 % des Reisepreises.
Bis zum 30. Tag vor Reiseantritt 90 % des Reisepreises.
Bei frühzeitiger Abreise zu 100% des Reisepreises.
Darüber hinaus ist in jedem Falle eine Storno-/Bearbeitungsgebühr in Höhe von 60 €
zu zahlen. Die Rücktrittgebühr wird mit der Anzahlung verrechnet. Der Abschluss
einer Reise-/Rücktrittskosten-/-Abbruchversicherung wird dringend empfohlen.
§ 7 Rücktritt durch den Vermieter
Ein Rücktritt durch den Vermieter kann nach Mietbeginn ohne Einhaltung einer Frist
erfolgen, wenn der Mieter sich nicht an die Hausordnung sowie nicht an die angegebenen Ruhezeiten hält und trotz Abmahnung
nachhaltig stört oder sich in solchem Maß vertragswidrig verhält, dass die sofortige Aufhebung des Mietvertrages gerechtfertigt ist.
§ 8 Haftung des Vermieters
Der Vermieter haftet im Rahmen der Sorgfaltspflicht eines ordentlichen Kaufmanns
für die ordentliche Bereitstellung des Mietobjekts. Eine Haftung für eventuelle
Ausfälle bzw. Störungen in Wasser- oder Stromversorgung, ausgenommen, solche
die vom Vermieter direkt verursacht wurden sowie Ereignisse und Folgen durch
höhere Gewalt sind hiermit ausgeschlossen.
Der Vermieter haftet für Ansprüche gleich aus welchem Rechtsgrund bis zu einer
Höhe von maximal 100% des zu zahlenden Mietzinses. Diese Anwendung findet
keine Anwendung auf Vorsatz und (oder) Personenschäden.
§ 9 Schriftform
Andere als in diesen AGBs aufgeführte Vereinbarungen bestehen nicht.
Die allgemeinen Geschäftsbedingungen werden akzeptiert mit Überweisung der Anzahlung oder aber der Zahlung des gesamten Mietpreises.
§ 10 Salvatorische Klausel
Sollte eine der zuvor beschriebenen Mietbedingungen rechtsungültig sein, so wird
Diese, durch eine sinngemäß nächste kommende Regelung ersetzt. Die anderen
Mietbedingungen bleiben davon unberührt und weiterhin gültig.

§ 1 Booking confirmation
The rental agreement for the Ferienhaus-Wehr is legally binding upon receipt of the booking confirmation and upon receipt of the
deposit (see §2). By transferring the deposit, the tenant and their fellow travelers accept the general terms and conditions and
the house rules as binding.
§ 2 Payment
The deposit of 20%, but at least €200, shown in the booking confirmation must be transferred to the landlord’s account within 7
days of the booking confirmation.

Purpose: Rental period and name
If the tenant fails to pay the deposit on time, the landlord is entitled to rent the holiday home to another party.
The remaining payment is due 30 days prior to arrival. For short-term bookings, the travel price must be transferred immediately.
§ 3 Arrival and Departure
The holiday home is available from 2:00 PM on the day of arrival.Claims for damages cannot be asserted if, as an exception, the
holiday home cannot be occupied promptly by 2:00 PM. On the day of departure, the holiday home must be left swept clean by
10:00 AM.
§ 4 Rental Property
The holiday home is rented with a complete inventory. Any
shortages, defects, or damage must be reported to the landlord immediately. Any complaints regarding the condition of the
apartment and its inventory will only be acknowledged within 24 hours of arrival. After that, any damaged/missing items must be
replaced.
The inventory must be treated with care and attention; pets are not allowed on the sofa or in the beds. The inventory is intended
for use only in the holiday home. The tenant is liable for damages resulting from a culpable violation of their duty of care and
notification, particularly in the case of improper handling of technical equipment and other furnishings. The tenant is also liable
for the negligence of their fellow travelers. Damage caused by force majeure is excluded from this liability.
In the event of use of the holiday home in breach of contract, such as subletting, overcrowding, disturbance of the peace, etc., as
well as non-payment of the full rent
(§ 2), the contract may be terminated without notice. Any rent already paid remains with the landlord.
Bed linen, sheets, and towels are included in the rental price. Taking them to the beaches is prohibited and will be charged.
The Wi-Fi connection is part of the rental property, but continuous streaming of videos should be avoided.
Costs for electricity, water, and heating are included in the rent, as long as they are within normal limits. If electricity
consumption exceeds 20 kWh/day and water consumption exceeds 0.5 m³/day, the tenant is responsible for any excess costs.
The house rules are part of the booking confirmation.
Violations of the house rules and/or the general terms and conditions may lead to immediate termination of the rental
agreement. In these cases, there is no entitlement to a refund of rent already paid.
§ 5 Stay
The minimum stay for the holiday home is two nights.
The holiday home may only be occupied by the maximum number of people stated in the booking confirmation. In case of
overcrowding, the landlord reserves the right to refuse entry to the excess guests or to charge an appropriate surcharge.
§ 6 Cancellation Conditions
Any necessary cancellation of the trip must be communicated in writing. In the event of cancellation, the landlord remains
entitled to payment of the agreed trip price.
The landlord is entitled to compensation according to the following scale:
Up to 90 days before departure: 20% of the tour price.
Up to 60 days before departure: 60% of the tour price.
Up to 30 days before departure: 90% of the tour price.
In case of early departure: 100% of the tour price.
In addition, a cancellation/processing fee of €60 is payable in all cases. This fee will be deducted from the deposit.
Travel/cancellation/interruption insurance is strongly recommended.
§ 7 Withdrawal by the landlord
The landlord may terminate the tenancy without notice after the start of the tenancy if the tenant fails to comply with the house
rules and the specified quiet hours, and despite warnings, causes persistent disruption, or behaves in such a way that the
immediate termination of the tenancy agreement is justified.
§ 8 Liability of the landlord
The landlord is liable within the scope of the duty of care of a prudent businessman
for the proper provision of the rental property. Liability for any outages or disruptions in the water or electricity supply, except for
those directly caused by the landlord, as well as events and consequences due to force majeure, are hereby excluded.
The landlord is liable for claims, regardless of the legal basis, up to a maximum of
100% of the rent to be paid. This does not apply to intentional misconduct and/or personal injury.
§ 9 Written form
There are no agreements other than those listed in these Terms and Conditions.
The Terms and Conditions are accepted upon transfer of the deposit or payment of the entire rental price.
§ 10 Severability Clause
Should any of the rental terms described above be legally invalid, they will be
replaced by a provision that is closest in meaning. The other rental terms remain unaffected and continue to apply.
